By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Account Registration and Eligibility

1.1 Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

• Agree that we will never use Your Content to train AI models or share it with third parties
• Accept full responsibility for ensuring Your Content does not infringe on third-party intellectual property rights

2.2 AI-Generated Content

The Service generates content using artificial intelligence, including editing feedback, marketing materials, and cover designs ("AI-Generated Content"). You acknowledge that:

• AI-Generated Content is provided as suggestions and recommendations, not professional advice
• You retain full ownership and commercial rights to all AI-Generated Content created for your manuscripts
• We grant you an unrestricted, perpetual license to use AI-Generated Content for commercial purposes
• You are responsible for reviewing and verifying AI-Generated Content before publication
• We make no warranties regarding the accuracy, completeness, or suitability of AI-Generated Content

2.3 Our Intellectual Property

The Service, including its design, features, code, and proprietary AI models, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

3. Copyright Infringement and DMCA

3.1 Copyright Attestation

When uploading a manuscript, you must certify that:

• You are the copyright owner, or
• You have obtained all necessary permissions to upload and process the work

3.2 DMCA Compliance

We comply with the Digital Millennium Copyright Act (DMCA). If you believe content on our Service infringes your copyright, please submit a DMCA notice as described in our DMCA Policy.

3.3 Penalties for False Attestation

Uploading copyrighted material without authorization is illegal and may result in:

• Immediate account suspension or termination

• Liability for damages and attorney's fees

4. Subscription Plans and Billing

4.1 Plan Types

We offer the following subscription plans:

• Free Plan: 1 manuscript per month, basic analysis, 30-day storage
• Pro Plan ($29/month): 10 manuscripts per month, full features, 1-year storage
• Enterprise Plan ($99/month): Unlimited manuscripts, team features, unlimited storage
• Pay-Per-Analysis ($10): One-time payment for individual manuscript analysis

4.2 Billing and Payment

By subscribing to a paid plan, you agree to:

• Provide valid payment information
• Authorize automatic recurring charges to your payment method
• Pay all applicable taxes and fees
• Update your payment information if it changes or expires

4.3 Subscription Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan.

4.4 Cancellation

You may cancel your subscription at any time from the billing dashboard. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No refund will be issued for partial billing periods
• Your account will revert to the Free plan at the end of the billing period

4.5 Upgrades and Downgrades

• Upgrades: Take effect immediately, and you will be charged the prorated difference
• Downgrades: Take effect at the end of your current billing period

5. Usage Limits and Restrictions

5.1 Manuscript Limits

Each plan has monthly manuscript limits. If you exceed your limit:

• You will be prompted to upgrade your plan or purchase a one-time analysis
• Your existing manuscripts remain accessible
• Limits reset at the beginning of each billing period
• Unused manuscripts do not roll over to the next billing period

5.2 Prohibited Uses

You agree not to use the Service to:

• Upload content that infringes intellectual property rights
• Upload malware, viruses, or malicious code
• Attempt to reverse engineer, decompile, or hack the Service
• Use automated tools to scrape or extract data from the Service
• Resell or redistribute the Service without authorization
• Upload illegal, harmful, threatening, or abusive content
• Violate any applicable laws or regulations

5.3 Fair Use

We reserve the right to enforce fair use policies to prevent abuse. Excessive usage that impacts Service performance may result in account restrictions.

6. Data Storage and Retention

6.1 Storage Duration

• Free Plan: 30 days
• Pro Plan: 1 year
• Enterprise Plan: Unlimited
• Pay-Per-Analysis: 90 days

6.2 Data Deletion

After the storage period expires, your manuscripts and analyses will be permanently deleted. You are responsible for downloading and backing up your data before the storage period ends.

6.3 Account Deletion

If you delete your account, all your data will be permanently deleted within 30 days. This action cannot be undone.

7. Disclaimers and Limitations of Liability

7.1 No Professional Advice

The Service provides AI-generated suggestions and feedback for informational purposes only. It does not constitute professional editing, legal, or business advice. You should consult qualified professionals for editorial, legal, or financial decisions.

7.2 No Guarantees of Publication Success

We make no guarantees regarding:

• Publication success or book sales
• Amazon KDP acceptance or ranking
• Accuracy of market analysis or predictions
• Quality or effectiveness of AI-generated content

7.3 Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service failures (e.g., OpenAI, Stripe)

7.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Manuscript Publishing Platform, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your Content uploaded to the Service

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information and manuscript data.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting the updated Terms on this page with a new "Last Updated" date

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
